Terms of Service
1. Preamble
These Terms of Service (the “Terms”) define the conditions under which you may access and use the Grooves application (the “Service”), available at grooves-golf.com and through the iOS and Android mobile apps.
Use of the Service is conditional on full acceptance of these Terms. By creating an account or accessing the Service, the User acknowledges having read and accepted them without reservation.
2. Definitions
- Publisher: the person or company operating Grooves (“Grooves”).
- User: any adult natural person creating an account or accessing the Service.
- Service: the Grooves application as a whole, including game analysis, training program generation and progress tracking features.
- Account: the User's personal area, accessible after authentication.
3. Description of the Service
Grooves is an application that provides golfers with a personalized training program based on the analysis of their rounds (game statistics, scores, courses played). The Service generates structured sessions tailored to each User's level and weaknesses.
The Service is available 24/7, subject to maintenance operations or force majeure. Grooves reserves the right to modify, suspend or discontinue all or part of the Service at any time.
4. Registration and account
4.1 Registration conditions
Registration is open to any adult natural person. The User undertakes to provide accurate information and to keep it up to date.
4.2 Authentication
Authentication is performed via Google OAuth or by magic link sent by email. The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account.
4.3 Account deletion
The User may request account deletion at any time from their settings or by contacting Grooves. Deletion results in the permanent erasure of associated data, subject to any legal retention obligations.
5. Pricing
The Service is free during the beta phase. Grooves reserves the right to introduce paid features or a subscription at a later date, after prior notice to Users and without retroactive effect on existing subscriptions.
6. User obligations
The User undertakes to:
- Use the Service in accordance with its intended purpose and applicable laws;
- Not attempt to bypass security measures or disrupt the Service;
- Not reproduce, modify or distribute all or part of the Service without written authorization;
- Not use the Service for commercial purposes without prior agreement.
7. Intellectual property
All elements of the Service (interface, text, logos, code, drills, programs, educational content) are the exclusive property of Grooves and protected by applicable intellectual property laws. Any reproduction, representation or exploitation, in whole or in part, without prior written authorization, is prohibited.
Data entered by the User (rounds, scores, profile) remains their property. The User grants Grooves a non-exclusive license to use it solely for the purpose of providing the Service.
8. Personal data
Processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms.
9. Liability
Grooves undertakes to provide the Service with due care, without guaranteeing the absence of interruptions or errors. Programs and advice provided are educational in nature and do not replace the opinion of a qualified professional (PGA, physiotherapist, physician).
The User remains solely responsible for how they use the Service and for the sessions they perform. Grooves shall not be held liable for injuries, damages or losses resulting directly or indirectly from use of the Service.
10. Suspension and termination
Grooves reserves the right to suspend or delete any account in case of breach of these Terms, without notice or compensation. The User may terminate their account at any time, free of charge, from their settings.
11. Changes to the Terms
These Terms may be modified at any time. Users will be informed of material changes by email or in-app notification. Continued use of the Service after notification constitutes acceptance of the new Terms.
12. Governing law and jurisdiction
These Terms are governed by French law. Failing amicable resolution, any dispute shall be brought before the competent French courts.
